On January 1, 2023, the Law of Ukraine “On the Construction Products Providing on the Market” came into force, which significantly changes the requirements for manufacturers and suppliers of building materials.

By the end of 2025, all Ukrainian manufacturers of building materials are required to start working under the new law, also known as EU Regulation 305, because according to the Cabinet of Ministers Resolution No. 426, almost all types of construction products fall under its scope: from a bolt to a chimney.
The key difference between the new law and the old technical regulation of 2006 is that it refers to European standards for the manufacturing of building materials and obliges Ukrainian manufacturers to draw up declarations of conformity with product characteristics and to bear full responsibility for them.
According to the requirements of the Regulation 305, the manufacturer is obliged to draw up a declaration with the characteristics of the products, which are determined by the European standards harmonized in Ukraine, to conduct continuous quality control of the production process and to take responsibility for the compliance of the products with the parameters specified in the declaration.
Suppliers of products from EU countries, where the Regulation 305 has been in force since 2011, will be able to switch easily to work under the new rules, since some of them are familiar with the declarations or have been declaring the characteristics of imported materials and structures on a voluntary basis. For example, Rauta has been providing declarations of conformity for Ruukki sandwich panels and ventilated facades cladding since 2016.

Improving product quality. The law provides for the production of building materials according to European standards, which have higher requirements for quality and safety.
Better consumer protection. Thanks to a unified system of quality control requirements and a liability mechanism, consumers receive clear criteria for choosing products and leverage to influence unscrupulous manufacturers.
Simplification of Ukrainian manufacturers’ entry into the EU market. A unified certification system allows domestic companies to supply their products to the European Union without additional testing and certification.
Liberalization of the building materials market. Declarations have to be registered by the manufacturer in the Unified State Electronic System in the Construction Sector, which increases the transparency of relations between the supplier, buyer and the state.
On November 27, 2024, the EU adopted a new Regulation 2024/3110, which entered into force on January 7, 2025 with a transition period of 1 year. The new European Regulation 3110 replaces the previous 305, on which the Law of Ukraine “On the Construction Products Providing on the Market” was based.

The implementation of Regulation 305 is a significant step forward in bringing Ukrainian legislation closer to European. The new rules will require companies to restructure business processes and sometimes modernize production equipment, which will lead to improved product quality and open up new opportunities for the development of Ukrainian business.
